The key code development is Public Act 103-0510, which took effect January 1, 2025 and established the IRC as the statewide residential baseline — meaning that even jurisdictions without their own adopted code must now comply with CDB-adopted codes. Before that date, Illinois had no mandatory statewide residential building code, and large swaths of rural downstate Illinois operated effectively without enforceable residential code requirements.

The practical picture is more nuanced. As of 2025, locally adopted codes must be at least as stringent as the IRC for structural matters, but the statute also permits a builder and purchaser to agree on the code edition in unincorporated areas. ICC inspector certification becomes mandatory statewide from January 1, 2027. Enforcement remains a local function, and in rural downstate counties it can still be inconsistent. Verify the current code adoption status and enforcement posture with the specific county before you pull permits.

Zoning is the more common friction point than building code in rural Illinois. Agricultural zoning in most downstate counties accommodates residential use on acreage parcels, but that’s not universal — verify the parcel’s zoning classification before purchase.
